General Terms and Conditions of Sale

These conditions are applicable to all sales concluded with the hotel Campanile Metz Centre Gare, 90 Rue aux Arènes, 57000 Metz; with the exception of group bookings. As a result, the customer acknowledges having read these general terms and conditions of sale and undertakes to comply with them.

These conditions of sale can be modified at any time and the applicable conditions will be those in force on the date the reservation is made.

 

1) Booking

For each reservation made, a reservation number will be given to you. This number will allow you to cancel your reservation if necessary. Please note that no cancellation, modification or refund is possible in the case of online payment.

All bookings made on the Internet require a credit card number and an expiry date as a guarantee.

Payment for your stay is made on site at the end of your stay, unless you do not show up at the hotel and have not previously cancelled your reservation. In which case the amount of the first night will be charged to you.

In addition to cash, the following payment methods are accepted: Visa, American Express, MasterCard, Diner's Club, Maestro, Eurocard. We also accept payment by Holiday and Cadhoc Cheques. Payment by cheque is not accepted. Please inquire directly with the hotel for any further information.

 

2) Cancellation conditions

Except for offers that cannot be modified or cancelled, any cancellation can be made the same day, on the Internet, at the head office or at the hotel before 6:00 pm. A cancellation number will then be issued to you.

 

3) Prices

The prices displayed on our website are in euros. They are displayed all taxes included, excluding the daily and personal tourist tax collected on behalf of the municipality. Our prices are subject to change at any time without this being applicable to reservations already confirmed, unless there is a change in the legal or regulatory fees imposed by the competent authorities.

 

4) Non-modifiable, non-cancellable offers

We are led to propose promotional offers for which no cancellation or modification is possible. Pursuant to Article L121-21-8 of the Consumer Code, the right of withdrawal provided for in Article L121-21 is not applicable.

 

5) Online payment

Our website offers a single online payment. The entire stay will be charged to your credit card. Payment on site is made by credit card (Visa, Mastercard, Eurocard, American Express) via a secure online payment system. You will be asked for the credit card number, the trigram on the back of the card and the expiry date. Any payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the customer will result in the cancellation of the order at the customer's expense, without prejudice to any civil or criminal action against him.

All orders are placed following the following steps: choice of request criteria; proposal of one or more offers; summary of the order in detail with the total price; verification and correction of the order if necessary; final validation of the order after validation of our general conditions of sale; online payment in secure mode; display of the detailed order confirmation at the email address provided.

The booked stay is only definitively acquired after the effective debit of your credit card and receipt of our confirmation. The confirmation shall be deemed to represent the agreement of the parties.

The customer is invited to exercise the greatest diligence in the presentation of any claim in order to allow it to be processed under the best possible conditions.

 

6) Complaints

Any request for information or complaints must be addressed to the hotel directly. The client is invited to send any claim relating to a stay as soon as possible, in order to facilitate its processing. He must also have taken care during his stay to report any inconvenience in order to limit any possible consequences.

 

7) Dislocation

In the event that, for any reason beyond your control, we are unable to secure the reservation made, we will make our best efforts to relocate you at our expense to a hotel of at least an equivalent category located nearby.

 

8) Protection of personal data

Please refer to our legal notices regarding the general data protection regulations.

 

9) Liability and warranty

The customer acknowledges the risks associated with the use of the Internet. We will make our best efforts with our suppliers to ensure the proper functioning of the site but cannot guarantee that this site is free of any anomaly or malfunction. We therefore cannot be held liable for damages resulting from the use or total or partial inability to use the site. In particular, we cannot be held liable in the event of non-performance or improper performance by the customer, a third party or due to force majeure.

 

10) Applicable law

These general terms and conditions of sale are subject to French law. In accordance with Article L141-5 of the Consumer Code, the consumer may, at its choice, bring an action before the court of the place where it resided at the time of conclusion of the contract or the occurrence of the harmful event, in addition to one of the courts with territorial jurisdiction under the Civil Procedure Code. However, the parties undertake to make their best efforts to reach an amicable settlement.

In order to provide you with suitable offers, we also process data relating to your interests based on your consumption data during your stay on site.

We collect the data that result from your interactions with us, on the website, by phone, via hotel comparators or directly during your stay.

What data do we collect?

-      Identification data such as: title, surname, first name, email address, postal address, date of birth, postal code, country, language of communication, your mobile and/or fixed telephone number and possibly the recording of your telephone conversations when you make a reservation by telephone

-      The data of your stay: dates, number of nights, destination, presence of an adult/child

-      Your credit card details

-      Data related to your device and connection, including: IP address, Internet connection, browser type, information about the device used

-      Geolocation data, interests and consumption data if you have used a mobile device

In general, the lack of information in the fields identified in the site by an asterisk (*) does not allow us to provide you with all or part of the services we offer and the functionalities of the site and your requests may not be taken into account.

The other fields are optional and are intended to improve the quality of the services offered to you.

When a form (opinions, contacts) offers a free field, we ask you not to indicate any personal information and to limit yourself to the information strictly necessary to process your request. We reserve the right to remove any unnecessary information at your request. We do not collect sensitive data about you.

We automatically collect technical data (IP address, internet connection, browser type, information about the device used) and data collected using cookies when using the services. For more information on cookies, please refer to our cookie management policy.

We may indirectly collect your personal data from some of our partners who record your booking from their own websites and may or may not collect the booking price on our behalf.

These partners are online hotel comparators or search engines such as Booking.com, Expedia, Kayak, Google Ad Words, Google Hotels Ads, TripAdvisor, Skyscanner, Trivago.

They collect and transmit to us the data necessary for your reservation. These partners may collect other data on their own behalf that we do not have access to.

These companies process the personal data you provide on their own behalf. Therefore, we encourage you to review their privacy policies to understand how and why they treat the data you provide to them.

 

3) Your rights as a customer

In accordance with the provisions of articles 15 to 21 of the RGPD and 38 to 40 of the Data Protection Act, you have, as a person concerned by the processing of personal data, a right of access, rectification, deletion, limitation and portability on your personal data that we process. You also have the right to file a complaint with the competent supervisory authority, the Commission Nationale de l'Informatique et des Libertés (CNIL).

5) How long do we keep your data ?

Any financial penalty that may be imposed on Metz Tgv Invest Hotel will be at your expense, in particular by any decision of a French administrative or judicial court, or by an independent administrative authority such as the Commission nationale de l'informatique et des libertés (CNIL), as a result of your failure to comply with your obligations under this Personal Data Policy.
